1. Agreement to Terms
By accessing or using BitMarks ("the Service"), operated by BitMarks ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
BitMarks is a cloud-synced bookmark management platform that allows users to store, organize, search, and synchronize bookmarks across devices. The Service includes a web application, browser extension, and API.
3. Account Registration
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to access the Service beyond the provided API
- Store or transmit malicious code through the Service
- Resell or redistribute the Service without our written consent
5. User Content
You retain ownership of all bookmarks, tags, folders, and other data you store through the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and transmit your User Content solely for the purpose of providing the Service to you. We do not claim any ownership rights over your User Content.
6. Encryption and Data Security
BitMarks offers end-to-end encryption for bookmark data. When encryption is enabled, your data is encrypted on your device before being transmitted to our servers. We cannot access encrypted content. You are solely responsible for maintaining your encryption keys and passwords. Lost encryption keys cannot be recovered by us.
7. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service downtime.
8. Subscription and Payments
Certain features of the Service may require a paid subscription. Payment terms, pricing, and billing cycles will be presented at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.
9. Termination
You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, you may request an export of your data within 30 days.
10. Limitation of Liability
To the maximum extent permitted by law, BitMarks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
